ORDINANCE 2010-10
AN ORDINANCE OF THE TOWN OF
CHESTERTON,  PORTER COUNTY, INDIANA,
REGULATING VEHICULAR TRAFFIC WITHIN THE TOWN
WHEREAS, Indiana Code authorizes municipalities to impose restrictions on the 
operation of vehicles upon highways under their jurisdiction; and
WHEREAS, the Town of Chesterton Street Commissioner has recommended the adoption 
of the vehicle weight restrictions contained in this Ordinance to promote the 
health, safety and public welfare of the residents of the Town of Chesterton, 
and to prevent the accelerated deterioration of the highways and streets 
affected by this Ordinance; and
WHEREAS, the Chesterton Town Council has studied the matter and now concurs in 
the recommendation of its Street Commissioner.
NOW THEREFORE, BE IT AND IT IS HEREBY ORDAINED by the Town Council of the Town 
of Chesterton, Porter County, Indiana, as follows:
SECTION ONE: No person shall operate any vehicle having a gross vehicle weight, 
with load, in excess of thirty-six thousand (36,000) pounds on County Road 1050N 
between State Road 149 and County Road 200W or on County Road 200W as such is 
contained within the Town limits of the Town of Chesterton.
SECTION TWO: The Town of Chesterton Street Commissioner is authorized and 
directed to erect signs specifying the restrictions set forth in this Ordinance 
on the portions of streets and highways affected by the terms of this Ordinance 
and at intersecting streets and highways and to remove them upon the expiration 
of the effective dates of this Ordinance.
SECTION THREE: The restrictions contained in this Ordinance shall not apply to 
vehicles making local deliveries.  For the purposes of this Ordinance, vehicles 
making local deliveries shall be defined as vehicles delivering or picking up 
goods at locations which are situated on or immediately adjacent to the portions 
of the streets and highways identified in this Ordinance.
SECTION FOUR: Violations of the traffic regulations set forth in this Ordinance 
shall be included on Appendix B to the Chesterton Town Code and processed, for 
first time offenders, through the Ordinance Violations Bureau with a fine of two 
hundred fifty dollars ($250.00) to be assessed.  In the event the fine is not 
paid within thirty (30) days from the offense, the matter shall be filed with a 
Court of competent jurisdiction and the general penalty provision of said Code, 
found at Section 1-9, shall apply.  Any subsequent violations of this Ordinance 
by the violator shall subject said violator to the general penalty provision of 
said Code found at Section 1-9.  All amounts collected pursuant to this section 
shall be deposited in the Town General Fund. 
SECTION FIVE: This Ordinance shall be in full force and effect on August 13, 
2010, after its adoption and publication as required by law and shall remain in 
effect thereafter for a period of ninety (90) days.
ALL OF WHICH IS PASSED AND ADOPTED by the Chesterton Town Council this 26th day 
of July, 2010.
