ORDINANCE 2010 -09
AN ORDINANCE OF THE CHESTERTON TOWN COUNCIL AMENDING THE
CHESTERTON TOWN CODE
WHEREAS, the Chesterton Utility Service Board has experienced an increase in the
amount of delinquent sanitary sewer utility bills for rental properties located
within the Town of Chesterton; and
WHEREAS, under Indiana law, charges for sanitary sewer service are chargeable
against the property served and remain the legal responsibility of the owner of
the property; and
WHEREAS, the Chesterton Utility Service Board has recommended an amendment to
the Chesterton Town Code to make a change to the manner in which rental
properties are billed for sanitary sewer service; and
WHEREAS, the Chesterton Town Council has reviewed the matter and now concurs in
the recommendation of the Utility Service Board, believing it to be in the best
interests of the Town.
NOW, THEREFORE, BE IT AND IT IS HEREBY ORDAINED by the Chesterton Town Council
as follows:
SECTION ONE. Section 25-86(B) of the Chesterton Town Code shall be amended and
hereafter read as follows:
B. The rates and charges will be billed to the owner of the real estate
serviced.
SECTION TWO. Funds currently held in the utility service deposit fund
established pursuant to Section 25-97 of the Chesterton Town Code which have
been deposited by individuals or entities other than owners of property and are
being held by the Town pursuant to Section 25-95 of the Chesterton Town Code
shall be distributed to the depositor on January 1, 2011, less any sewer charges
and penalties chargeable to the property for which the deposit is being held.
SECTION THREE. Effective January 1, 2011, Section 25-95 of the Chesterton Town
Code shall be deleted in its entirety.
SECTION FOUR. This Ordinance shall be in full force and effect from and after
its adoption and publication as required by law.
PASSED AND ADOPTED by the Chesterton Town Council, Porter County, Indiana, this
26th day of July, 2010.
