A South Bend resident was arrested Tuesday on the Indiana Toll Road for operating while intoxicated with minors in the vehicle, OWI prior conviction, dealing marijuana, and operating without receiving a Driverís License, the Indiana State Police said.

According to police, at approximately 10:26 p.m. Steven P. Smith, 37, was eastbound in the left lane of the Toll Road traveling at a high rate of speed at the 2.5 mile marker which is 2.5 miles east of the Indiana/Illinois state border in Lake County.

Police said Smithís vehicle was clocked at 108 miles per-hour in a well posted 70 mph zone and performed unsafe lane movement, nearly sideswapping another car.

Police said they stopped Smith and noticed a female passenger in the front seat, and a male passenger and three children in the rear passenger seats. The children ages were 15, 13 and 5 years old, police said.

Police said Smith had an overwhelming odor of alcoholic beverage and slurred speech. Smith refused to submit to a chemical test and further investigation revealed that he had approximately 15 grams of marijuana, individually packaged, on his person, police said.

The car and occupants were turned over to the male passenger who was a valid driver and sober, police said.

Smith was transported to Lake County Jail.
