A Liberty Township resident was arrested Sunday on charges of operating
while intoxicated and five counts of neglect of a dependent, Burns Harbor
Police said.
According to police, at 9:40 p.m. Jason Vidal Garcia, 31, of 54 Canterbury
Circle, was stopped in the area of U.S. Highway 20 and Burns Blvd. after an
officer clocked him at 59 miles per hour in a zone posted at 45. Police said
that Garcia showed signs of intoxication, failed several field sobriety
tests, and subsequently registered a blood alcohol content of .10 percent on
a chemical test.
Motorists in Indiana are considered legally intoxicated when they score a
B.A.C. of .08 percent or higher.
Police also said that one young child was riding in the front seat and four
young children in the rear seat. Three of the latter were not seatbelted at
all, police said, while the fourth was sitting in a safety seat “not secured
to the vehicle in anyway nor was (the child) even secured to the safety
seat.”
“Garcia stated he was unaware the children were not properly restrained or
that his speed was excessive,” police said.
Garcia was charged with OWI and OWI with a minor in the vehicle and five
counts of neglect of a dependent, police said. He was also issued five
citations, one for speeding and four for child restraint violations, police
said.
