A Portage Township man is facing a minimum of five years in a federal prison
after pleading guilty to receipt of child pornography, the U.S. Attorney’s
Office for the Northern District of Indiana said.
Terrance Shawn Young, 49, with a listed address of 618 Oxford Road, has
agreed to plead guilty to the first count of the indictment, in exchange for
which a second—possession of child pornography—will be dismissed, according
to court documents.
Under the agreement, the U.S. Attorney’s Office will recommend to the court
“a sentence equal to the minimum of the applicable U.S. sentencing
guidelines. The agreement, however, is not binding on the court.
Also recommended: an “offense-level calculation” which takes into account
one “decrease” and four “enhancements”:
•A decrease because the “offense conduct was limited to the receipt or
solicitation of material involving the sexual exploitation of a minor” and
did not involve trafficking or distribution.
•An enhancement because Young was in possession of material “which involved
a prepubescent minor.”
•An enhancement because he was in possession of material “which portrays
sadistic or masochistic conduct or other depictions of minor.”
•An enhancement because Young used a computer during the commission of an
offense.
•An enhancement because he was in possession of more than 600 images.
Young will also be sentenced to a minimum of five years of supervised
release, will be required to register as a sex offender, and must submit to
a psycho-sexual evaluation.
According to the complaint filed by U.S. Homeland Security Investigations,
an investigation begun in March 2010 into persons who had accessed the
www.liberalmorality.com website showed probable cause that the user of an IP
address, traced to Young’s residence, had received or attempted to receive
child-pornographic images.
On Dec. 16, 2011, a search warrant was executed at Young’s home and an
on-scene forensic examination of computers found in the master bedroom
yielded “over a hundred images of suspected child pornography” as well as
over 500 videos, the complaint stated.
Young admitted “that he views pornography on the computer and when agents
asked if he ever viewed child pornography, he said yes that on occasion he
came across some images on the Internet,” the complaint stated.
“When asked if law enforcement would find any images on his computer,
Terrance Shawn Young said there would be ‘probably 10 images’ on the
computer,” the complaint stated.
