LEGAL NOTICE

The Town of Beverly Shores, Indiana is inviting all interested and eligible vendors to submit sealed combined lump sum bids for the sale to the Town of two (2) NEW 2010 FWD Ford Escape Hybrid vehicles, or E-85 compatible equals, and the acceptance of two Town vehicles as trade-ins. The new vehicles must be equipped with at least all standard equipment which is more particularly identified in the Invitation for Bids.

Because this purchase will be funded by federal CMAQ grant funds, each bidder MUST complete, sign, and submit all of the following with its bid: 1) Disbarment of Suspension Certification; 2) Certification of Compliance With Federal Motor Vehicle Safety Standards; and 3) Lobbying Certification. Copies of these forms are included herewith. In addition, the relevant terms of the General Terms and Conditions Associated With Federal Contracts which is included herewith will be incorporated by reference into the purchase/sale contract.

Each bidder must submit an original and three (3) copies of its Bid. All bids shall be binding for thirty days after bid opening. All bids that are timely submitted will be opened, and the winning bid selected and awarded by the Town Council. The bid will be awarded to the lowest responsible, responsive bidder. The Town reserves the right to reject all bids and to waive any formalities or inadvertent errors. The Town reserves the exclusive right to determine whether an alternate is equal or better than the item specified in its Specifications.

In order to be considered by the Town Council, a sealed bid must be delivered to the Clerk-Treasurer's Office or the Town Council no later than the time at which the opening of the bids is called for by the Council's presiding officer during the meeting of the Town Council on February 8th, 2010 which meeting is scheduled to begin at 7:00 pm local time in the Town Hall located at 500 South Broadway, Beverly Shores, Indiana. Bids may be delivered to the Clerk-Treasurer's Office at the Town Hall prior to that time during its regular business hours of 9:00 am to 1:00 pm, local time, Monday through Friday, except holidays.

Bids may be submitted in person, by U.S. Mail, or by private carrier but the bidder is solely responsible for insuring that the bid's delivery is timely and any bid that is delivered late will not be considered, regardless of the cause for late delivery. Any Bid that is not timely delivered will be marked as received but will not be opened. The mailing address for the Beverly Shores Town Hall is P.O. Box 38; Beverly Shores, IN 46301-0038. All envelopes or containers containing a bid must clearly state "Sealed Bid For New Vehicles" on the outside of the container in which it is delivered.
