RESOLUTION NO. 09-02

INDEMNIFICATION AGREEMENT

WHEREAS, The Town of Ogden Dunes, does hereby acknowledge by way of official resolution by its Town Board that the Town of Ogden Dunes has notified the Sheriff of Porter County that it intends to hire off-duty members of the Porter County Sheriff’s Department, to perform law enforcement services for the town.

WHEREAS; The Town of Ogden Dunes represents to the Sheriff of Porter County that said off-duty members of the Porter County Sheriff’s Department so employed will be empowered and authorized to act in the capacity of Deputy Town Marshall solely under the authority and direction of the Town Marshall and/or Town Board.

WHEREAS: The Town of Ogden Dunes further represents to the Sheriff of Porter County that said off-duty members of the Porter County Sheriff’s Department will not use county equipment, weapons or vehicles in the discharge of their on behalf of the town.

NOW THEREFORE:

The Town of Ogden Dunes agrees to hold harmless and indemnify the county of Porter, its duly elected Sheriff, its elected officials, employees and members of the Porter County Sheriff’s Department from any liability including attorney fees that may arise as the result of this employment. It is further agreed that Town of Ogden Dunes will provide for the cost of defending any such action and further pay any damage award rendered as a result of any legal action brought in any federal or state Court.

The Town of Ogden Dunes further represents that this agreement will be binding on any or all successors and principals in office, and it is made with full knowledge of its direction and import.
