NOTICE OF A HEARING

ON PROPOSED RATES AND CHARGES

Property owners and other interested parties of the White Oak Conservancy District are hereby notified that Ordinance No. 09-01, amending the established rates and charges for services to be collected by the White Oak Conservancy District, was introduced at a meeting of the Board of Directors on August 13, 2009. At a meeting of the Board of Directors to be held at 7:00 p.m. on September 10, 2009, at the Wheeler United Methodist Church at 307 North Street, Wheeler, Indiana there will be a public hearing on the matter of amending the rates and charges for sanitary sewer collection services, and consideration of adoption of said Ordinance 09-01, which provides in part as follows:

Section 1. That Section 3(a) of Ordinance 94-2 (as amended) should be and the same is hereby amended to read as follows:

(a) Sewage rates and charges shall be determined by equivalent single family dwelling units. Sewage service bills shall be rendered for periods of service equaling a month. The schedule on which said rates and charges shall be determined is as follows:

All other rates and charges contained in Section 3(a) of Ordinance 94-2 (as amended) shall be adjusted to reflect the modification in the billing charge and the equivalent dwelling unit charge as contained in this Ordinance.

Section 2. All other terms and conditions of Ordinance 94-2 (as amended) shall remain in full force and effect.

Section 3. The sanitary sewer rate increases contained in this Amendatory Sewer Rate Ordinance shall take effect as of October 1, 2009.

At such hearing and prior to final adoption of said Ordinance, all interested parties may appear and be heard. A copy of Ordinance 09-01 may be examined at the offices of the attorneys of the Conservancy District, BLACHLY TABOR BOZIK & HARTMAN, 56 South Washington Street, Suite 401, Valparaiso, Indiana 46383.
