ORDINANCE NO 752

AN ORDINANCE OF THE OGDEN DUNES TOWN COUNCIL AMENDING THE OGDEN DUNES TOWN CODE

WHEREAS, the Ogden Dunes Town Council has initiated an amendment to the text portion of its Zoning and Subdivision Control Ordinance: and

WHEREAS, the Ogden Dunes Plan Commission, in considering this proposal, has paid reasonable regard to the factors contained in I.C.§36-7-4-603; and

WHEREAS, notice was given in accordance with Indiana Code of all proceedings concerning this proposed text amendment to the Zoning and Subdivision Control Ordinance, a public hearing was held before the Ogden Dunes Advisory Plan Commission and said Plan Commission has certified its proposal to amend the text of its Zoning and Subdivision Control Ordinance to the Ogden Dunes Town Council; and

WHEREAS, the Ogden Dunes Town Council concurs with the Plan Commission’s recommendation and accepts its proposal to amend the text of the Zoning and Subdivision Control Ordinance.

NOW THEREFORE, BE IT AND IT IS HEREBY ORDAINED by the Ogden Dunes Town Council as follows:

SECTION 1: That Section 152.002 of the Ogden Dunes Town Code shall be amended by a revision to the definition of “Building Commissioner” contained in said section. The term Building Commissioner shall now read as follows:

BUILDING COMMISSIONER. The Building Commissioner of the Town of Ogden Dunes. Wherever the term “Building Commissioner” is used in this chapter it shall also mean any Deputy Building Commissioner appointed by the Ogden Dunes Town Council.

SECTION 2: This Ordinance shall be in full and effect from and after its passage, adoption and publication as required by law.

ALL OF WHICH SHALL BE ADOPTED this 5th day of July, 2011 by the Ogden Dunes Town Council.
