ORDINANCE 2011-08

AN ORDINANCE OF THE CHESTERTON TOWN COUNCIL

AMENDING THE CHESTERTON ZONING MAP

WHEREAS, Lewis N. Graff and Lisa M. Graff, have filed a Petition requesting a change to the Chesterton Zoning Map for real estate they own generally located on Mekeland Lane, lying North of US Highway 20 and West of N. 200 East, in Chesterton, Indiana; and

WHEREAS, the Chesterton Advisory Plan Commission conducted a public hearing on the aforementioned rezoning petition on May 19, 2011; and

WHEREAS, the Chesterton Advisory Plan Commission has certified the rezoning proposal with a favorable recommendation to the Chesterton Town Council; and

WHEREAS, the Chesterton Town Council concurs with the recommendation of its Advisory Plan Commission; and

WHEREAS, the Chesterton Advisory Plan Commission and the Chesterton Town Council have paid reasonable regard to the criteria set forth in Ind. Code 36-7-4-603 in considering the rezoning proposal; and

NOW, THEREFORE, BE IT AND IT IS HEREBY ORDAINED by the Chesterton Town Council as follows:

SECTION 1: That the Chesterton Zoning Map shall be amended showing the rezoning of the following legally described property from B-3 to R-1:

Parcel A: A parcel of land in the Southeast Quarter of Section 19, Township 37 North, Range 5 West of the 2nd P.M. Beginning at a point which is 622.3 feet West and 750 feet South of the Northeast corner of the Southeast Quarter of Section 19, Township 37 North, Range 5 West of the 2nd P.M., and running thence South parallel with the East line of the Southeast Quarter, a distance of 200 feet; thence East parallel to said North line of said Southeast Quarter, a distance of 122.3 feet; thence North parallel to said East line, a distance of 200 feet; thence West parallel to said North line, a distance of 122.3 feet to the point of beginning, containing .5615 acres, more or less.

Parcel B: A parcel of land with a North boundary and a South boundary of 122.3 feet and an East boundary and a West boundary of 200 feet adjacent and contiguous to the West boundary of Parcel (A) described above.

Both of the above-described parcels are a part of Deed Record 307, page 195, recorded in the Office of the Recorder of Porter County, Indiana and are located in the Southeast Quarter of Section 19, Township 37 North, Range 5 West, all in Porter County, Indiana; which property is commonly known as 190 East Mekeland Lane, Chesterton, Indiana.

SECTION 2: This ordinance shall be in full force and effect from and after its adoption and publication as required by law.

ALL OF WHICH IS PASSED AND ADOPTED by the Town Council of the Town of Chesterton, Porter County, Indiana, this 13th day of June, 2011.
