ORDINANCE NO. 751
AN ORDINANCE OF
THE OGDEN DUNES TOWN COUNCIL ESTABLISHING A FEE TO BE CHARGED FOR
GARBAGE/REFUSE/TRASH PICK UP AND DISPOSAL IN EXCESS OF THE AMOUNT REQUIRED
TO BE PICKED UP IN PURSUANT TO CONTRACT WITH WASTE HAULER
WHEREAS, the
Ogden Dunes Town Council presently has a contract with Able Disposal, a
division of Republic Services, Inc. to pick up one (1) garbage tote and one
(1) recycling tote on a weekly basis per residence; and
WHEREAS,
occasionally residents put out quantities of materials in addition to what
Able Disposal is required to pick up; and
WHEREAS, the Town
of Ogden Dunes is willing to pick up items that are garbage/refuse/trash in
excess of the amount Able Disposal is contractually required to dispose of
for a reasonable fee.
NOW, THEREFORE,
BE IT AND IT IS HEREBY ORDAINED by the Ogden Dunes Town Council as follows:
SECTION 1: In the
event a residence desires to have garbage/refuse/trash or other acceptable
items picked up outside of the contractual obligation of Able Disposal, the
Town will, in its discretion, pick up the items for a charge of $25.00 per
backhoe or tractor bucket. The Town may, in its sole discretion, refuse to
pick up items or amounts it deems unacceptable.
SECTION 2: This
Ordinance shall be in full and effect from and after its passage, adoption
and publication.

SHALL BE ADOPTED this 2 day of May, 2011 by the Ogden Dunes Town Council:
