NOTICE OF PUBLIC HEARING ON PROPOSED RATES AND CHARGES
Property owners, ratepayers and other interested parties in or served or to be served by the 
Damon Run Conservancy District (“District”) are hereby notified that on May 26, 2011 at 4:00 p.m. at 1 W. Shakespeare, Valparaiso, Indiana there will be a public hearing on the matter of Ordinance No. 2011-01, which ordinance proposes amending the rates and charges for the water services associated with the District’s water system in accordance with the rates and charges of its service provider, Indiana American Water Company, and consideration of adoption of Ordinance No. 2011-01. A true and complete copy of Ordinance No. 2011-01 is attached hereto.
ORDINANCE NO. 2011-01
AN ORDINANCE AMENDING THE DAMON RUN CONSERVANCY DISTRICT WATER RATE ORDINANCE TO INCREASE THE RATES PAYABLE TO THE DAMON RUN CONSERVANCY DISTRICT
WHEREAS, the Damon Run Conservancy District (”District”) enacted its Ordinance No. 2006-1 titled Water Rate Ordinance (”Initial Water Rate Ordinance”) which Initial Water Rate Ordinance was amended by as amended by Ordinance No. 2009-02 (”Amended Water Rate Ordinance”) (collectively “Water Rate Ordinances”);
WHEREAS, the Initial Water Rate Ordinance and Amended Water Rate Ordinance established, among other things, a schedule of rates and charges regarding the use and operation of the District’s water works; and
WHEREAS, upon review of information and recommendation of the District’s accountant, the District’s agreement with the Indiana American Water Company (”Water Company”) for the provision of water and obligations pursuant to the laws of the State of Indiana, the Board of the District has determined that it is necessary amend the Water Rate Ordinances, to make certain adjustment to the Rates and User Fees associated with the District’s water works.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE DAMON RUN CONSERVANCY DISTRICT, PORTER COUNTY, INDIANA AS FOLLOWS:
1. Incorporation of Recitals. The above and foregoing recitals are true and correct and are hereby incorporated into this Ordinance.
2. Amendment to Water Rate Ordinance. The corresponding sections of the current Water Rate Ordinances are hereby deleted in their entirety and are replaced with those sections provided for in Exhibit “A” attached hereto and incorporated herein. The rates set forth herein in are intended to match the rates and billing frequency for the Northwest Indiana Operations approved by the Indiana Utility Regulatory Commission (”IURC”) under the tariff filed by the Water Company as IURC No. W-18-A pursuant to IURC Order approved on April 30, 2010 in IURC Cause No. 43680. In the event of any inconsistency between Exhibit “A” and the rates and charges approved by the IURC, the rates and charges approved by the IURC shall prevail.
3. Amendment Subject to IURC Approval. The passage and adoption rates and charges provided for in this Ordinance are subject to the review and approval of the IURC.
4. Scope and Effect. This Ordinance shall be in full force and effect from and after its passage and approval by the IURC. Except as expressly modified and amended herein, the Initial Water Rate Ordinance and the Amended Water Rate Ordinance, as previously amended, shall remain unchanged and in full force and effect.

GENERAL WATER SERVICE
Available for
All general water service customers except sale for resale customers.
Billing Frequency
Bills for general water service shall be rendered on a monthly basis; except for Northwest Indiana Operations which allows for bi-monthly billing. The following sets forth the schedules of volumetric rates on a monthly basis and on a bi-monthly basis (Northwest).
Volumetric Rates

Area One Group includes: Crawfordsville, Johnson County, Kokomo, Muncie, Newburgh, Noblesville, Northwest, Richmond, Seymour, Shelbyville, Somerset, Southern Indiana, Sullivan, Summitville, Wabash Valley and Waveland
Area Two Group includes: Mooresville, Wabash, Warsaw, West Lafayette and Winchester

Customer Charge
All metered general water service and sale for resale customers shall pay a Customer Charge based on the size of meter installed (or multiple meters installed--in which case, the charge is based on the total of all meters installed). The Customer Charge rates are listed below and do not include any allowance for water usage.*

CLASSIFICATION OF SERVICE
FIRE SERVICE
PUBLIC FIRE PROTECTION SURCHARGE
Applicability
Applies to customers not located within the boundaries of the governmental entities responsible for public fire service in the areas listed in Public Fire Hydrants. Applicable to any water customer located in areas within municipal boundaries or to any water customer within 1,000 feet of a public fire hydrant (measured from the hydrant to the nearest point on the property line of the customer) on the Company’s distribution mains in areas not within municipal boundaries. In addition to the charges for water service under currently approved tariffs, a public fire protection surcharge shall be charged to, and collected from, each customer to whom said surcharge is hereby made applicable. If multiple meters are installed the surcharge (s) shall be based upon the total of all meters installed.

Distribution System Improvement Charge (DSIC)
The Distribution System Improvement Charge (DSIC) Percentage set forth on this schedule is applicable where clearly denoted on other rate schedules, and this percentage shall be added to the volumetric rates and metered service charges billed. Changes to the DSIC shall be occasioned by filings in accordance with Indiana Code Chapter 8-1-31.

DSIC Percentage Rate	3.16%
At the hearing and prior to adoption of Ordinance 2011-01, all interested parties may appear and be heard. The Ordinance shall be effective upon adoption and otherwise subject to IURC approval as provided for in the Ordinance. A copy of Ordinance No. 2011-01 may be examined a the office of the District.
