ORDINANCE NO. 750

AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF OGDEN DUNES, INDIANA, AMENDING TITLE VII, CHAPTER 73, SCHEDULE I SEASONAL PARKING RESTRICTIONS AND SCHEDULE III HANDICAPPED PARKING OF THE OGDEN DUNES TOWN CODE.

Whereas, the safe circulation of traffic of all kinds through the streets of the Town is necessary to the safety, convenience and welfare of the public;

Whereas, the Ogden Dunes Police Department and Ogden Dunes Street Department have conducted a study and have recommended the establishment of expanded seasonal parking restrictions and handicapped parking within the Town; and,

Whereas, the State of Indiana has authorized towns to enact ordinances that control and regulate the standing or parking of vehicles upon any street, public way, or public place within the town:

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF OGDEN DUNES, INDIANA, AS FOLLOWS:

Section I. Title VII TRAFFIC CODE, CHAPTER 74; PARKING SCHEDULES, Schedule I Seasonal Parking Restriction and Schedule III, are hereby amended to read as follows:

SCHEDULE I. SEASONAL PARKING RESTRICTIONS.

The following streets or portions thereof as indicated are designated as restricted parking areas from May 1 of each year to the officially observed Labor Day of each year, both dates inclusive:

Street Location

Beach Lane - All

Cedar Trail - From Shore Drive to Ogden Court

Diana Road - From Sunset Trail to Shore Drive

East Hill Road From Turrett Road to Shore Drive

Hillcrest Road - First two lots on the south side beginning from the Diana Road-Hillcrest Road intersection

Locust Place - From Diana Road south to the end

Ogden Road - From Ogden Court east to the end

Shore Drive - All

Tamarack Road - All

Turret Road - All

SCHEDULE III. HANDICAPPED PARKING.

(a) Any person who parks a motor vehicle which does not have displayed a placard of a person with a physical disability or a disabled veteran, issued under the laws of the State of Indiana or another state, or a registration place of a person with a physical disability or a disabled veteran, issued under the laws of the State of Indiana or another state, in a parking space reserved for a vehicle of a person with a physical disability commits a town code violation.

(b) Any person who knowingly parks in a parking space reserved for a person with a physical disability while displaying a placard to which neither the person nor the person’s passenger is entitled commits a town code violation.

(c) Any person who displays for use in parking in a parking space reserved for a person with a physical disability a placard or a special license plate that was not issued under the laws of the State of Indiana or another state commits a town code violation.

(d) A person who, in a parking space reserved for a person with a physical disability, parks a vehicle that displays a placard or special registration plate entitling a person to park in a parking space reserved for a person with a physical disability commits a town code violation if that person is not, at that time, in the process of transporting a person with a physical disability or disabled veteran.

In addition to other properly marked spaces, handicapped parking shall be reserved at the following designated locations:

2 - Studio 5 Building @ 72 Hillcrest Road

1 - North-side Shore Drove @ East Hill Road (in-front of 18 Shore Drive)

1 - North-side Shore Drive east of Cedar Trail (in-front of 54 Shore Drive)

1 - South-side Shore Drive west of Diana Road (at approximately 115 Shore Drive)

1 - South-side Shore Drive far west-end (at approximately 157 Shore Drive)

1 - Town Hall @ 115 Hillcrest Road west-side of Hillcrest Road

1 - Firehouse @ 11 Hillcrest Road at east-end of parking lot

Section II. All prior Ordinances or parts thereof inconsistent with any provisions of this Ordinance are hereby repealed.

Section III. This Ordinance is hereby passed and adopted at a regular meeting of the Town Council of the Town of Ogden Dune, Indiana, this 4th day of April, 2011.
