ArcelorMittal Burns Harbor, LLC, has applied for a Restricted Waste Site Type I (RWS I) disposal facility permit for Deerfield Storage Facility located at 250 West US Highway 12.

Notice is hereby given that the Indiana Department of Environmental Management (IDEM) has opened the comment period for this solid waste facility permit application and will conduct a public hearing to receive comments on this application.

Background and Applicable Regulations

On June 17, 2009, ArcelorMittal Burns Harbor, LLC, submitted an application for an RWS I disposal facility to IDEM for Deerfield Storage Facility. This application is a request to construct and operate an RWS I disposal facility. The proposed disposal facility will be owned and operated by ArcelorMittal Burns Harbor, LLC.

Public Meeting

On November 18, 2009, ArcelorMittal Burns Harbor, LLC, will conduct a public meeting regarding this application. The meeting will include a brief description of the proposed RWS I application, information on where copies of the application have been filed, descriptions of any design alternatives being requested, fact sheets from IDEM on the proposed RWS I application, and an opportunity for public comments and questions. The meeting will be held on November 18, 2009, beginning at 3:00 PM (CST) concerning the solid waste permit process and the proposed application. The public meeting will be held at the Burns Harbor Town Hall, located at 1240 North Boo Road in Burns Harbor, Indiana 46304.

Public Hearing

The hearing will be held on December 2, 2009 beginning at 6:00 PM (CST) concerning the solid waste permit process and the proposed RWS I application. The public hearing will continue until 9:00 PM (CST). The public hearing will be held at the Northwest Indiana Regional Planning Commission (NIRPC) located at 6100 Southport Road in Portage, Indiana 46368. The intent of the Public Hearing is to solicit written and oral technical comments from all interested parties. It will not be an administrative adjudication under IC 4-21.5-1.

Public Review and Comment

Interested persons are invited to submit written comments on the proposal. The application is available for review at the Westchester Public Library located at 200 West Indiana Avenue, Chesterton, Indiana. This application can also be found for review online through the IDEM Virtual File Cabinet (VFC) search utility, which can be accessed at:

Due to the large size of many of the drawings, plans, and narratives, VFC documents are best viewed with a high-speed Internet connection.

Testimony will be received from all interested parties at the hearing, in either oral or written form. Persons presenting oral testimony are requested to submit one written copy of the statement. Written statements may be submitted up to ten (10) days following the Hearing.
